Terms of Service for PlantCopilot

1. Acceptance of Terms

By downloading, accessing, or using the PlantCopilot mobile application ("App") and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

PlantCopilot provides AI-powered plant identification, health diagnosis, and gardening care reminders (the "Service"). The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the accuracy, reliability, or availability of the Service.

3. IMPORTANT: AI & Gardening Disclaimer (Crucial!)

• Informational Purpose Only: The plant identification, health diagnosis, and care advice provided by PlantCopilot are generated by Artificial Intelligence (AI) and are for informational purposes only.
• Not Professional Advice: The App does not constitute professional botanical, agricultural, or expert advice. AI models can make mistakes.
• Limitation of Liability: You acknowledge that you use the App's advice at your own risk. We are not responsible for any damage to your plants, loss of crops, or any other loss resulting from your reliance on the App's suggestions. Always consult a local expert for critical gardening decisions.

4. User Accounts

• Anonymous & Registered Usage: You may use the App anonymously or sign in via third-party providers (Apple, Google).
• Account Security: You are responsible for maintaining the security of your device and account.
• Data Sync: While we strive to sync your data across devices securely using cloud services, we are not liable for any data loss caused by network errors, device failures, or third-party service outages (e.g., Supabase, Cloudflare).

5. User Content and Licensing

• Ownership: You retain ownership of the photos and data ("User Content") you upload to the App.
• License to Us: By uploading User Content, you grant PlantCopilot a worldwide, non-exclusive, royalty-free license to use, host, store, and display your content solely for the purpose of operating, developing, and improving the Service.
• Research & Improvement: You explicitly agree that we may use anonymized User Content (stripped of your personal User ID) to train our AI algorithms and for research purposes, even after you delete your account.

6. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose.
• Reverse engineer, decompile, or attempt to extract the source code.
• Upload content that contains viruses, malware, or is illegal/offensive.
• Abuse our APIs or interfere with the proper working of the Service.

7. Termination

• By You: You may stop using the App at any time. You can delete your account and personal data via the in-app settings.
• By Us: We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct we believe violates these Terms.

8. Limitation of Liability

To the fullest extent permitted by law, in no event shall PlantCopilot (or its developers, affiliates, and partners) be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, use, goodwill, or other intangible losses.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
